TARRANT DA SAYS: TASB HAS COMPLETE POWER OVER THE PEOPLE'S ELECTED BODY IN THE FWISD





The Tarrant County District Attorney Sharon Wilson provided a response to a request regarding the legality of the appeal for the Palazzolo case.  The question has been how TASB moved ahead with the appeal without a board vote.  You can read the letter following the link but in summary:

*The TASB contract with FWISD back in 2010 when the issue ensued is valid until the case is resolved all together.  In layman terms, TASB can drag this case out for as long as it wants because it has full control of the case.  The Board does not have to vote on anything they do.

*DA Wilson states that due to the clauses in the contract the board has no say in what TASB does because in layman terms it sold it's soul to the devil.

Never in our life would we have thought that in the United States of America who prides itself in the rule of law and representation would we think that one entity, TASB, would have power over an elected representative body the FWISD Board of Trustees.  Taxpayers are funding the legal matters of the FWISD and the board cannot stop the process in any manner according to the district attorney.  Foremost that there is no violation of the open meetings act.
We have an authoritarian mentality in every aspect of the Board, the District, the City and looks like the state.  You swear to protect the constitution and yet the values professed do not protect the people who elected the board to work in the best interest of those it represents.  In this case there is no representative government whatsoever because the contract stipulates and is interpreted one sided.

We do need the TOMA suit to proceed so that we can get a second opinion from a different court or perhaps a jury if possible.  Brings to mind when you retain an attorney, they represent and do what they need but with your knowledge.  Yet you can break the contract when you feel your rights and best interests are not being represented.  How then can a body created by the State of Texas and given power to rule be dumbed down by one lawyer from TASB?

So much for one person, one vote.

  2. There are a couple of things about this letter and specifically its exhibits which don't ring true. For example, where is page 3 of the contract? Also, why does the expense sheet end on August 2012? How much has been paid/expended in legal fees since then? The trial was in 2014. What did that cost? Seems to me there are several paragraphs the Board should have already taken note of. Specifically, I'd read paragraph 12 on page 16 of 23. This agreement in no way waives the BOE of it's duty to make the ultimate decision. Paragraph 1 Appeals under "General Provisions" seems to spell out something the Board should have already done given the expenses (as Mr. Harris states in his letter) "............do not seem to justify further use of taxpayer dollars".

  4. Well Ann and Tobi, as I see it you're still not off the hook. For God's sake do something to end this. How much has this Board REALLY spent on this case? Since the $$$ is coming from the General Fund, it is $$$ that should be going to our classrooms. We will be watching Tuesday.

  5. I believe this is the first time that any response from the DA regarding the board has been shown to the public. As far as I know this is the first time the DA has responded to anything about the board. It is nice to get something from that office even if it basically says that we are still so screwed. I also believe that this Harris has no contacts here but he works for someone that certainly does so I completely discount that denial that his opinion is objective and not influenced by local politics. I am puzzled by the idea that TASB would pursue a case that Joe has won in almost every aspect except getting his job back. Why would they pursue an appeal that by all reason has no chance of being successful? Also if the TASB has complete control, why would the board vote to reject the settlement proposals? Bottom line to me is something continues to be rotten in Cowtown.

  6. I may be mistaken, but isn't Needham the District's liaison or rep for TASB? I remember reading this on CIA. TASB IS NOT in control, because Needham has been and will continue to be, in control for as long as she is still breathing! Me personally, I wish someone would push her toward the light!

  8. As to “objectivity” - the letter is addressed to Raul and no one is “cc’d”. As of this a.m., Raul still has not received this letter yet FWISD not only had the letter yesterday but was distributing it. Yes, the 3rd page of the contract regarding cost is missing. Obviously - intentionally so. Para 12 would seem to cover instances such as lying to the Court about the
    DOE investigation/letters. The Board has done nothing about that. Nor has anyone (including Ann) done anything about the threats to her by TASB’s attorney Brandt while she was on the stand testifying. Now it appears that the agreement with TASB expired in 2012 NOT 2013. At that point, FWISD had spent over 1.2 million with TASB and over 565,000 with Walsh Anderson before they quit. IT HAS BEEN THREE YEARS AND A TRIAL SINCE THEN. Any wonder FWISD is NOT responding to ORR requests for their costs to pursue this? The GED “study” proves TASB does what FWISD wants. "Fed Up" is correct. It all goes back to Needham – the “Taxpayer Watchdog”; the “Queen of Bond Concrete”. This is $$ that should have been going to the classroom. The best part? FWISD is asking for a new trial. Where’s that change Tobi? Time for
    the Board to really take charge. Guess it was no coincidence that one of Ray Dickerson’s questions to candidates during interviews for “Citizens for Great Schools” was; “How would you vote on the Palazzolo case?”
    Someone on the BOE needs to call for an end to this. We need the $$$ in the classroom.

  9. For those who did not read the transcript or listen to the meeting, it was Brandt the TASB attorney. You're correct Ann. This should have been enough to invoke the "Appeal" provision of the agreement - if in fact this agreement is still binding. You do realize TASB is spending FWISD's money correct? Please end this ANN. We need the $$ in our classrooms. It is obvious TASB/FWISD has spent far more in legal fees than Joe was awarded by the Jury.

  10. Absolutely correct. The proof is the TASB "GED study". If you Google Brandt you will find this is not his first rodeo with questionable conduct. His tactics not only cost the Mayor of Arlington the recent election, but almost both of their lives as well. After using similar tactics on a Strip Club owner, the guy put a "hit" out on both Brandt and the former Mayor. Just saying...........

  11. Just remember this guy is an attorney with an opinion. The only way this mess is going to be settled is in Court. Why did the Board VOTE to appeal the Commissioner's decision to reinstate Joe, to District Court and when they lost there, to the same Appeals Court - but not now?

While it seems that TASB would have a say on the case since they started it, how do you account for taxpayer money? Can we have the totals even for this past year that was spent? What is the district hiding?

  15. There is a MAJOR problem with this response. Why would an objective D.A. mail copies of a letter to third parties and NOT to the addressee residing in the SAME postal area? This "agreement" used as an attachment dated 2003 is NOT the same "agreement" provided in an ORR to Linda LaBeau in October 2014. Her agreement which was published in CIA was dated 2013. It was the renewal agreement FWISD DID NOT not sign. So why did FWISD attorney's provide a FALSE DOCUMENT in response to an ORR? WHY would the objective D.A. exclude page 3 from the document he used to rely upon for his argument? Why is page 3 missing? Probably because it spells out the EXCLUSIONS TASB does not cover which includes legal, expenses, fees, and damages resulting from retaliation, fraud, etc. etc. We can only speculate at this point. Board Members; THIS is called FIDUCIARY RESPONSIBILITY. You need to IMMEDIATELY start asking questions as to what is going on.

  17. Missing pages, lack of fuditiary responsibilty, false documents, so forth and so on...smells like the 7th St. Gang continues to be at the helm of corruption. I wonder how much $ Leonard and Needham contributed to Sharon Wilson's campaign and the creep before her! I'm so sick of FTW and the corruption within its Governmental bodies. To think that we would all still be going along with our lives, blind, stupid and lied to, if the AHHS/Palazzolo debacle hadn't surfaced. Almost 5 years have passed and some of us know more about our district (and City) than we EVER wanted to know! And this knowledge has come at a heavy price for people like Palazzolo, teachers, staff and kids. TASB, BOE, the Mayor and her Commisioners, DA; they ALL could care less about our kids and more about Federal money, kickbacks, and personal agendas. You all are right; the DA has never even addressed anything related to FWISD before. The only reason Wilson has, it's because she is new and doesn't want to appear corrupt from the onset. Make no mistake, she, like her predecessor, are on the take to sway the law in favor of our District. Nothing has changed and very little might from this point forward, unless someone with some morals ends this 5 yr baffoonery! Thanks, CIA for keeping up with Palazzolo and holding this District accountable. Let's end this crap once and for all.

  20. My interpretation is IF an ISD member looses ISD is on the hook for trial legal fees. It would be interesting to make another Open Records request for the 3 TASB contracts plus any communication following contract guidelines such as must notify TASB in 45 days of severability, etc.

Every property taxpayer in Tarrant County should be storming central administration. The imperial attitude is let them eat cake!

  26. This request is addressed to Ann (as new Audit Committee member); Tobi (who promised UEA change in her anti-employee positions) and new Board President Cinto. FIDUCIARY RESPONSIBILITY. Regardless which version of documents provided by Central Office you look at, as of August 1, 2012 FWISD had incurred $1,162,266 with Brandt's law firm; $566,000 with Walsh Anderson; and untold thousands with others including the new law firm in San Antonio being used to delay responses to ORR. FWISD has refused to provide expenses on Palazzolo since 2012. It is now 2015. You have funded three years of additional litigation without public disclosure and transparency. This needs to be addressed in the next Board meeting. HOW MUCH HAS BEEN SPENT? WHY? What is the return on this investment? This is money that should have gone to classrooms. Please put this item on the agenda and release the information to the public. Were you aware that "your" appeal is requesting a NEW TRIAL? Are you kidding?

TASB "studies" have been used to justify everything wrong in FWISD from disbanding Equity and Advocacy to the GED promotions. Now we learn they are running wild with our tax dollars in senseless litigation. No wonder retaliation continues and great Teachers leave each year in droves. Too bad her District did not field a candidate to run against her - even if she is supported by the Needham machine. Every school in her district continues to be an abysmal failure. Feel for the kids. Parents wake up. You need to end this waste Ms. Moss. We need the $$$ in classrooms. Or have you not noticed?

  32. Maybe we should ask Moss to have TASB do a study on Employees who have affairs with their students and why some are prosecuted (mostly Latinos) and others are promoted or allowed to stay while Menchaca helps cover up. This is incredible. No wonder TASB is out of control in FWISD.

  34. It was recently reported in national news that TEXAS has hired more pedophiles than any other state. FWISD is not alone but it says a lot about our lack of due diligence as a state and district. This is why nepotism and cronyism by HCM should be policed. Every teacher who suspects another teacher, janitor, or anyone on their campus becoming too cozy with a student should make a report to Child Protective Services. Reporting is anonymous and could save a child from abuse.

  35. When enough taxpayers and property owners write letters to the DA about the rise in property tax to cover education the DA will be forced to respond APPROPRIATELY. Also write the Tarrant County Appraisal District to complain. The DA is an elected official. When enough taxpayers/property owners get fed up there is the power of the ballot box as well.

Then suddenly, after her arrest, a MIRACLE in the form of a previously non-existent note appeared. Now look at her. Better still, look at Sims and Needham. And we wonder why?

The three NEWBIES on this Board had better realize that though this mess (the WHOLE practice of using monies from the General Fund for retaliation against employees who report wrongdoing) did not begin with them, they are responsible for what has happened since they took office. Yes, Ashley - that is correct. Perhaps instead of constantly sticking your foot in your mouth as you parrot quotes for Dickerson and those who supported you, you should consider what happens if an outside agency DOES come in and audits what this Board has been doing with Taxpayer money. Though many argue Avilla is ethically challenged, as an attorney I am surprised he has not questions the out of control spending and ridiculous excuse that TASB is in charge. You are robbing children of $$$ - State, Federal and Local to pursue personal vendettas or just look away.

  39. FYI: Dansby originally offered Palazzolo the position which Dugan (who allegedly fathered a child with a student - now his wife) was promoted into. That offer was nixed by Needham. Incurred legal fees and expenses are in excess of $5 mil. I doubt Sutherland has the courage to push for disclosure of this.

  41. I'm not sure what you hoped to accomplish in Executive Session. With taxes on the rise, the burning question gaining momentum is HOW MUCH HAS THE BOARD SPENT ON THIS? I was referred to this site by my child's teacher and I am speechless at the corruption. As of August 2012 according to FWISD doc's, the Board had spent just over $1.7 million from the general fund on legal fees and expenses. This included grievances, TEA and TWC. It even covered the aborted appeal of his reinstatement by TEA which the Board voted on. The total must now be 3x that amount. You are accountable to US. This has to be made public. I am spreading the word.

What a horrible family she must come from?? Can you imagine how nothing was done on her behalf?? I mean nothing and we know pedophiles ARE REPEAT OFFENDERS and now there's a young daughter between them. This little girl is being raised BY A VICTIM and a PEDOPHILE! For those of you who think Mr. Dugan isn't a pedophile, SHE WAS A CHILD! That's not debatable and marrying her did not make her an adult!   43. There is a website which was referenced on CIA before naming TEACHERS who were arrested - all were Latinos. Then you have the white teacher at Benbrook Middle School who gave female students "massages", took photos of his hand on their bare legs, and who Menchaca and Linares protected (Robbins of course was MIA). Then there is the nipple pinching Principal (Black) who preying on children for four years. Menchaca covered it up with Dansby's protection; and then AHHS teacher Sabotin (white) who was also protected by Menchaca and Linares - thanks to Needham. Kind of funny in twisted way: $5 million to fire and fight Palazzolo even after he won at TEA and Jury trial. Yet the Board turns a blind eye to Dugan and the rest. Even Sutherland, Paz and Jackson are silent.

In theory this could have potential to improve things BUT NOT UNTIL WE RIGHT THE WRONGS in Fwisd not just pretend they don't exist! I'm beginning to think that it's never going to get better!   53. The Board had the letter before it went out. That means FWISD attorneys had it sooner and probably helped write it . In the least, they proofed it which explains why this Assist. D.A. referenced the 2003 and 2006 contracts instead of the 2010 or 2012. Raul received the letter three days after it was allegedly mailed. He lives in Fort Worth. He would have received it sooner if he lived in Denver. What a sad sad joke. But we can't lose heart. We MUST awaken the Public as to what is happening to FWISD.

I really believe if had had an affair with a student Joe P. would have been better off. In any event, if there is a new trial as FWISD is wanting, I hope all of this will come out.     Yeah I told myself that for several years too! Then when Palazzolo brought even more corruption to light, I thought for sure something would be done... I'm still waiting. They continue to operate without impunity and the corruption continues to spread like a cancer! I do believe in Karma and lets see... A house in France, six figure incomes, nepotism and cronyism (I would bet everything I own that at least 80-85% of upper management wasn't hired on qualifications), now we have defiled the very essence of education by paying those people more than a teacher with 10 years of experience and a PHD! Perhaps this lesson isn't about Karma PERHAPS ITS ABOUT TAKING SOME ACTION and NOT SITTING IDLY BY AS THESE EVIL PEOPLE DESTROY OUR DISTRICT and THIS PROFESSION! Our history tells us that REAL CHANGE came from DRASTIC MEASURES! Protests, boycotts, strikes, all by masses of people who DEMANDED change! Sadly too many are complacent and remain silent! Change will not happen here for some time!

  63. This last election demonstrated to me that non-partisan school board elections are not NON PARTISAN. Check the election results. Needham is a totally RED republican who doesn't believe in public education. When GW Shrub became Gov, he initiated a national movement to turn education into big b'ness through textbooks, testing and No Child Left Behind which were and are not intended to improve public education. Just take a look at the number of lobbyists in Austin lobbying the education committees and the stock values of these companies since 1994 grow and the donor lists to the R's. It is truly shameful especially since teachers and unions are barred from organizing. What was shocking to me was being told teachers' cannot "advocate" for students such as if a teacher is concerned a 3rd grader is not reading or comprehending math the teacher cannot tell the parent or refer the child to ISD educational psychologist evaluate for a learning disability. Additionally SPED punishes any evaluator for even suggesting testing a student or advising a parent of their safeguards to request evaluation. This is due to expense to the district. AND HOW MUCH DOES THIS DISTRICT PAY ATTORNEYS TO DEFEND RETALIATION AGAINST TEACHERS, ETC? Parents if your child is not reading by 3rd grade or able to do simple math, it is your right to an ARD (admission, review, and dismissal) within 10 days of written request for testing at the district's expense AND if you want to select your own educational psychologist (neuropsychologist) at the district's expense if you disagree with the district's testing results. The excuse given by your associations is referring for student evaluation is above your pay grade ....meaning you do not have the skills to refer a student for testing! BTW speaking of Capital Hill....IDEA laws have been stalled in DC because the R's won't agree with the D's on improving these laws section 503 and 504. Yep FWISD behaves like FWISD or vice versa????? This is a minority/majority district essentially we're back to education segregation. Where is Barefoot Sanders?

    Linda look I'm not trying to be preachy but, you were the BeST unknown candidate. You needed more exposure, you needed more teachers, and I'm sorry but signs too! I don't think any one thing but collectively it put you at a disadvantage. Look you would be hard pressed to find ANY TEACHER in this district who supported your opponent but NOT campaigning enough really made a difference. Unfortunately far too few people read this blog; I mean there are many but not enough. We still have far too many that live in a bubble and in their defense, our district makes spare time something of a luxury. Many teachers without husbands' income and even some that have that still work 2nd jobs or tutor to make ends meet. Sometimes knowing the truth isn't always convenient BUT NOW IS THE TIME TO INFORM the masses. As far as the other goofballs up for reelection, unless there's some fraud aloud to happen on Election Day, their days on this BOE are over! I'm fairly chummy with more than 30 long-time teachers in this district who have committed to making sure that THEY WILL NOT BE REElected! If you doubt that is possible, it took just 3 teachers to make sure ANN was heard! Ask ms. Spear how that happened or take my word, either way our numbers continue to grow! The only tough part will be ensuring there are other viable candidates! Parents listen to teachers and THEY VOTE! We will be heard!

Why does AHHS still have a coach (Needham's buddy from TCU) who for his third year, teaches NO CLASS and is not certified? Maybe Moss had TASB do another of their infamous studies to justify that.

  71. I just checked Ann's blog where she posted the next agenda. She states that her request to discuss Joe's appeal has been postponed until the completion of further court action. WHY? Who decided that? It was bad enough that it was going to be in executive session and not in the open but to essentially postpone it indefinitely is ridiculous. It doesn't matter that it's still under appeal. You CAN talk about it and explore ways to end this mess if you want to. Ann please give us an explanation why this was postponed. It seems that it's just more of the Needham BS.

I Actually have come to the realization that this district has so many layers of corruption that nothing shocks me anymore! This was first reported here months ago. Ann failed to follow up on that and has left all of us hanging as well. Just remember this is the same BOE who paid Dansby

  86. Today's Telegram reported David Harris resigned. I'd love to believe it had something to do with the letter he wrote but until that information is released, if ever, no way to know. His suspension happened to soon after the letter became public for me not to believe it did. Maybe he acted without the knowledge of the DA and when she and her handlers found out they canned him. Telegram has filed an ORR. If the DA acts like every other elected body around here the information might be released somewhere around the Texas bicentennial.

She is all caught up in being "one of the boys" Carlos suffered from this near the end when he though he would be accepted by Needham. She can't blame withdrawing her request this time on anyone else. When you re-read Harris' letter to Raul, you have to wonder how the entire BOE got a copy four days before Raul did and they are not even an addressee. The legal question is: Why would this "attorney" quote from an old and out-dated version of the contract and not the contract which was relevant at the time? Meanwhile, more CLASSROOM $$$$ down the tubes which even Sutherland does not seem interested in stopping.

  90. Perhaps you forget that after losing at TEA, TWC, District
    Court and about to lose at Appeals Court, it was SUTHERLAND's motion in 2012 that fired
    Palazzolo a second time (which she let Whatley write and explain). Once she,
    Vasquez and Rangel got rid of MJ, they had no further use for Chavez, Duran,
    Palazzolo, Gonzalez, Salinas, Tennyson and the rest of Teacher cases then
    pending and just wanted them to go away. Justice be damned. If you read the
    transcript you get a clearer picture of all the inside trading that was going
    on including denying Palazzolo an administrative hearing, Tatum getting that
    fake job in return for dropping the DOE complaint (allegedly) and Palazzolo
    never seeing most of his so-called "severance pay". It was all part
    of the deal. When the BOE refused to give him the required hearing, he filed
    the lawsuit. So now after reneging on their own settlement and insisting on a
    trial, the BOE is still throwing our $$$ away shopping for a verdict. Ann is
    now part of that.

  91. .All of you need to know there is a form of litigation know as "qui tam" which allows taxpayers to file a lawsuit against FWISD based on "waste, fraud and abuse". In doing research, I found that El Paso ISD was placed in conservatorship for the exact reasons, AHHS was perpetrating and later we learned Eastern Hills and other campuses were also committing. Taxpayers you can file a "class action suite" based on the May elections.

  93. My daughter and I went on the 2009-10 trip to Paris which Sabotin organized. He was paid kick back money for organizing this trip. It was a pure disaster. Not to sound boastful, but I lived my high school days in Paris so I know the city. Each traveler paid $5K just for flight and hotel. It was a complete disaster. Sabotin wrote me a very disrespectful email which I forwarded to Alexander and Dickerson, the district President at the time. Dickerson never acknowledged receipt of my letter. You know the rest of the Sabotin story. Don't be surprised to find him back in FWISD! Anyone want to start "playoff wager"? FWISD is a "made for TV movie:!

Why is the Board approving (or in the least failing to question) the hiring/retention of known pedophiles? Every teacher and most students know who these people are and know that they were reported to OPS. So why is Linares allowed to cover this up?
